Rights and Obligations
1. Patient Rights (according to Law no. 46/2003)
I. Right to Quality Medical Care
– Patients have the right to receive the highest quality medical care.
II. Right to Humane and Non-Discriminatory Treatment
– Patients have the right to be treated with dignity and without any form of discrimination.
III. Right to Medical Information
– Pacienții au dreptul să fie informați despre serviciile medicale disponibile și modul de utilizare a acestora.
– Patients have the right to be informed about the available medical services and how to use them.
– Patients have the right to be informed about the identity and professional status of healthcare providers.
– Hospitalized patients have the right to be informed about the rules and customs to follow during their stay.
– Hospitalized patients have the right to be informed about their health status, proposed medical interventions, procedure risks, available alternatives, consequences of refusing treatment, and non-compliance with medical recommendations, as well as details about their diagnosis and prognosis.
– Hospitalized patients have the right to decide whether they want additional information to avoid suffering caused by the information provided by the doctor.
– Hospitalized patients have the right to request that another person receives the information on their behalf.
– Hospitalized patients have the right to seek and receive a second medical opinion.
– Hospitalized patients have the right to receive a written summary of the investigations, diagnosis, treatment, and care provided upon discharge.
IV.Consent for Medical Intervention
– Hospitalized patients have the right to refuse or stop a medical intervention, taking responsibility for the decision in writing. The consequences of refusal must be clearly explained.
– In cases of medical emergency, the legal representative’s consent is not required.
– Consent is mandatory for the collection, storage, and use of biological products, provided the patient agrees.
– Consent is required for participation in clinical education and scientific research.
– Patients cannot be photographed or filmed without consent, except for purposes necessary for diagnosis or treatment.
V. Right to Confidentiality and Privac
– Patients have access to their personal medical data.
– Details regarding a patient’s health status, diagnosis, treatment, and prognosis are confidential, including after death.
– Confidential data may only be provided with the patient’s explicit consent or when required by law.
– Any interference with a patient’s privacy is prohibited unless necessary for diagnosis, treatment, or care, and with the patient’s consent.
VI. Right to Medical Treatment and Care
– Patients have the right to support from family, material aid, and spiritual support during medical care.
– Hospitalized patients have the right to receive medical services from an accredited doctor outside the hospital.
– Patients have the right to continuous medical care until their health condition improves or is cured.
– Patients have the right to emergency medical assistance.
2. Patient Obligations
– To respect the discipline rules of Cosmedica clinic.
– To carefully use the provided facilities, as any damage is subject to civil law regulations.
– To smoke only in designated areas.
– To refrain from bringing or consuming alcoholic beverages within the clinic.
– To wear the provided clothing and not leave the premises in this attire.
– To follow the diet prescribed by the doctor.
– To respect the visiting hours to avoid disturbing medical activities.
– To maintain cleanliness in their room and common areas.
– To address and communicate politely with medical staff.
– Making noises that may disturb other patients is prohibited.
